Wills: guidance on property and real estate

If you hold property as a Joint Tenant with your partner, or other person, your interest in that property will automatically pass to that individual based on ‘Right of Survivorship’. You can only pass on if that individual(s) is deceased and has been removed from the Title.

If you hold a property individually, or as a Tenant in Common, you can distribute the property as per your wishes through your Will.

If you would like more flexibility in how you can pass on a share of a property you hold as a Tenant in Common, or want to provide greater protection and flexibility to a child or other beneficiary, we strongly recommend you review information about Protective Property Trusts to see if this is the right approach for you.
