In adeus you name your children individually rather than leaving a gift to "my children" as a group, so your Will identifies exactly who you mean.
When deciding who to name, it helps to know how the law treats different relationships:
- Biological children and adopted children are your children in law.
- A biological child who has been adopted by someone else is treated in law as the child of their adoptive parents, and not as yours.
- Step-children are not automatically your children in law. If you want a step-child to inherit, name them in your Will in the same way as anyone else.
Naming each person individually avoids any doubt about who is included.
Note that where your Will passes a share to a beneficiary's issue because that beneficiary has died before you, a different rule applies. See issue (def.).
