The current requirement to have a paper based will, wet-signed in the presence of two witnesses, and stored undamaged for decades dates back almost 200 years!
Given advances in technology, and the way we live much of our lives online and using digital tools, not to mention the problems of fraud, forgery or loss of wills under the current requirements that results in an increasing number of contested wills, the Law Commission has been looking at how to improve the process.
In May 2025, the Law Commission published a draft bill for the U.K. Parliament to review. This will allow for ‘electronic wills’ and we will finally be able to bring wills into the 21st Century!
