What is Testamentary Capacity?

Testamentary capacity refers to the mental ability a person needs to possess to make a valid will. If a person lacks testamentary capacity, the will can be challenged in court and potentially declared invalid.

Questions about testamentary capacity are a leading reason for the continued increase in contested wills. This is compounded by an aging population and increasing incidence of people living with dementia and Alzheimer’s disease.

About the adeus Mental Capacity Assessment

We are currently developing an assessment to record mental capacity. This optional assessment will provide additional evidence of your testamentary capacity, reducing the likelihood of your will being contested.
